The concepts of ‘event’, ‘occurrence’, ‘risk’ and ‘accident’ in insurance law

Abstract

The above analysis demonstrates that the term ‘event’ in not always used in the same manner by the legislator and the contracting parties. As a result, its definition and interpretation may differ from case to case. When the term is used by the legislator, regard should be addressed to the purpose and need that the legislator wished to serve, while when used by the parties in contractual clauses the general principles of interpretation should apply.
