Aviation insurance on the London market

Abstract

This article was aimed at giving grosso modo review of the aviation insurance, the way of operation through a complex and exhaustive set of documents used on the London market and especially by Lloyd’s specialized syndicates. Compared to available contractual forms, special attention was given to two groups ofpolicies used on the London market in general. First group is intended for use in UK and other countries and second (with two special policies) for American jurisdiction.

S U M M A R Y

From the legal-technical point ofview, aviation insurance is by way of coverage method categorized into insurance „Against All Risks”. Because of this, use of term „risk” is not common. The only exception from this rule are insurance ofwar and political risks, which are for example cited in the AVN.48B clause and other appropriate clauses. Basic form for aircraft insurance today on the London market is AVN. 1A, which contain particular requirement that such policy is not and shall not be construed as a policy of Marine insurance. Aviation insurance policy for American market does not have such requirement, because they are in first instance adopted for use on that market.
